1. Agreement
These Terms of Service apply when you access or use AcadBoard. By using AcadBoard, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, you should not use AcadBoard.
2. About AcadBoard
AcadBoard is an academic dashboard that provides study, organisation, productivity, file, collaboration, and optional AI-assisted tools.
AcadBoard is designed to support learning and organisation. It is not a replacement for teacher advice, school instructions, professional advice, or independent judgement.
3. Definitions
AcadBoard means the AcadBoard website, web application, widgets, APIs, and related services.
User, you, or your means a person or organisation using AcadBoard.
User Content means content you upload, submit, create, store, process, or share through AcadBoard, including text, notes, files, images, PDFs, audio, video, schoolwork, lists, and dashboard content.
Third-Party Services means external services used by AcadBoard, such as hosting, authentication, AI processing, reference data, weather data, storage, and payment providers.
4. Eligibility and School Use
AcadBoard is intended for educational and productivity use. Students may use AcadBoard where they are permitted to do so by their school, parent, guardian, or applicable law.
If a student uses AcadBoard through a school, teacher, parent, or guardian, that person or organisation is responsible for ensuring any required consent or authorisation has been obtained.
You must provide accurate account information and keep your account secure. If you believe your account has been accessed without permission, contact us promptly.
5. Accounts and Sign In
AcadBoard may use third-party sign-in providers such as Google to authenticate users. You are responsible for maintaining access to the account you use to sign in.
We may refuse, suspend, or restrict access where reasonably necessary to protect users, protect AcadBoard, prevent abuse, comply with law, enforce these Terms, or respond to security concerns.
6. Acceptable Use
You agree not to use AcadBoard to:
- break the law or encourage unlawful conduct
- upload, store, or share content you do not have the right to use
- upload illegal, abusive, defamatory, harmful, or infringing content
- upload or share material involving the exploitation or abuse of minors
- harass, threaten, impersonate, or harm another person
- attempt to access accounts, data, systems, or areas you are not authorised to access
- interfere with AcadBoard, bypass limits, scrape the service, or test security without permission
- upload malware, phishing content, spam, or deceptive material
- use AcadBoard in a way that breaches your school rules or academic integrity policies
7. User Content
You retain ownership of your User Content.
You give AcadBoard a limited, non-exclusive licence to host, store, transmit, display, process, back up, and share your User Content only as reasonably needed to provide AcadBoard, operate requested features, maintain security, troubleshoot issues, support collaboration, comply with law, and enforce these Terms.
AcadBoard does not sell User Content.
AcadBoard does not use private notes, uploaded files, school data, live audio, OCR content, homework, grades, or personal workspace content to train AcadBoard-owned or third-party AI models unless we clearly disclose this for a specific optional feature and obtain any required consent.
8. Shared Content and Collaboration
AcadBoard includes features such as shared notes, shared lists, invite links, and file links. If you share content, people with access may be able to view, edit, download, copy, or further share that content depending on the feature and permissions you choose.
You are responsible for checking who you share content with and for removing access when it is no longer needed.
We may remove or restrict shared content if we reasonably believe it violates these Terms, another person's rights, school requirements, or the law.
9. AI, OCR, Captions, and Transcription
Some AcadBoard features use AI or transcription services to provide study assistance, OCR, summaries, live captions, translation, or similar outputs.
AI outputs may be inaccurate, incomplete, outdated, or unsuitable for your situation. You should check important information against reliable sources.
You must not submit AI-generated work as your own if doing so would breach your school, university, or organisation's rules.
You should not enter highly sensitive, confidential, medical, legal, financial, or private information into AI features unless you are permitted to do so and understand how the feature works.
Some AI features may use provider settings that allow inputs and outputs to help improve AI services. Those features should not be used with personal, sensitive, confidential, school, medical, legal, financial, or private information.
10. Third-Party Services
AcadBoard relies on Third-Party Services for selected features. These may include Google, Cloudflare, OpenAI, WeatherAPI, Wikimedia, Stripe, and similar providers.
Third-Party Services are subject to their own terms, privacy policies, reliability, and security practices. AcadBoard is not responsible for third-party services outside our reasonable control.
We may change, replace, suspend, or remove an integration where needed to maintain security, reliability, compliance, or service quality.
11. Privacy
Our Privacy Policy explains how AcadBoard collects, uses, stores, shares, and deletes information.
By using AcadBoard, you acknowledge that information may be processed as described in the Privacy Policy, including by third-party providers where needed for requested features.
12. Paid Features, Plans, and Credits
AcadBoard may offer paid plans, add-ons, AI credits, or usage-based features. Prices, limits, inclusions, and billing terms will be shown at or before purchase.
Paid features may be subject to usage limits, expiry periods, fair use controls, and technical restrictions.
Payments are handled by third-party payment providers such as Stripe. Refunds are provided where required by law or where expressly stated at purchase.
Nothing in these Terms excludes, restricts, or modifies rights you may have under the Australian Consumer Law or other laws that cannot be excluded.
13. Service Availability
AcadBoard is provided on an “as is” and “as available” basis. We aim to keep the service reliable, but we do not guarantee that AcadBoard will always be available, uninterrupted, error-free, or secure.
The service may be affected by maintenance, updates, technical issues, third-party outages, security events, internet problems, or other factors outside our reasonable control.
14. Data Loss and Backups
We take reasonable steps to operate and protect AcadBoard, but you should keep your own backup of important files, notes, schoolwork, and other content.
We are not responsible for loss, corruption, or deletion of User Content except to the extent required by law.
Backups may not include the most recent changes and may retain deleted content for a limited period before automatic expiry.
15. Account and Data Deletion
You may request account deletion or data deletion by emailing contact@acadboard.com from the email address associated with your account.
We may need to verify your request before deleting account data, shared content, uploaded files, or billing-related records.
Some information may be retained for a limited period where needed for backups, security, fraud prevention, legal compliance, billing, dispute resolution, or enforcement of these Terms.
16. Suspension and Termination
We may suspend, restrict, or terminate access where reasonably necessary to:
- protect users or the service
- respond to security risks
- prevent abuse, spam, fraud, or illegal activity
- comply with law, school requirements, or third-party provider requirements
- address serious or repeated breaches of these Terms
- manage non-payment or misuse of paid features
Where appropriate, we may provide notice or an opportunity to resolve the issue. We may act immediately where needed to protect users, data, the service, or legal rights.
17. Disclaimers
AcadBoard is an educational and productivity tool. It does not provide legal, medical, financial, professional, or official academic advice.
You are responsible for checking important dates, school requirements, assessment rules, AI outputs, calculations, references, and any information you rely on.
We do not guarantee specific academic outcomes, grades, productivity improvements, or acceptance by a school or organisation.
18. Limitation of Liability
To the maximum extent permitted by law, AcadBoard and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, academic outcomes, business interruption, or loss caused by third-party services.
Where liability cannot be excluded but can be limited, AcadBoard's total aggregate liability for a claim is limited to the amount you paid to AcadBoard for the service in the 12 months before the event giving rise to the claim.
If you have not paid AcadBoard, AcadBoard's liability is limited to the maximum extent permitted by law.
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law or other applicable laws.
19. Indemnity
If you use AcadBoard on behalf of a business, organisation, school, or other entity, you agree to indemnify AcadBoard for reasonable losses, costs, claims, and expenses caused by your unlawful use of the service, your breach of these Terms, or content you upload that infringes another person's rights.
For individual students using AcadBoard for personal educational use, this indemnity applies only to the extent permitted by law.
20. Changes to AcadBoard
We may update, modify, add, remove, suspend, or discontinue features from time to time. We may also change limits, plans, pricing, integrations, or technical requirements.
Where a change materially affects paid features, we will take reasonable steps to provide notice where appropriate.
21. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, provide notice through the site, app, or email.
Continued use of AcadBoard after updated Terms take effect means you accept the updated Terms.
22. Governing Law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the courts of Victoria, Australia for disputes relating to these Terms, unless a different process is required by law.
